Terms of Service

ExamPaths is owned and operated by Mojave Web Pro LLC, a Nevada limited liability company (“Company,” “we,” “us,” or “our”). ExamPaths provides online study materials and practice tools to help individuals prepare for insurance licensing examinations. Our principal place of business is Pahrump, Nevada. ExamPaths is an independent study aid. Our content is provided for educational purposes only.

We do not guarantee that use of ExamPaths will result in passing any examination. Passing an exam depends on many factors beyond our control, including individual preparation, test-taking conditions, and changes to exam content by the relevant testing vendor or regulatory body. Nothing on ExamPaths constitutes a promise, warranty, or representation that you will pass any licensing exam or obtain any license.

We are not affiliated with, endorsed by, approved by, sponsored by, or in any way officially connected to Pearson VUE, PSI Services, Prometric, the National Association of Insurance Commissioners (NAIC), or any state Department of Insurance. All third-party trademarks, service marks, and trade names referenced on ExamPaths belong to their respective owners and are used for identification purposes only. Such references do not imply sponsorship, endorsement, approval, or affiliation.

Always verify current exam requirements, question formats, and passing standards directly with the official testing vendor or your state’s Department of Insurance before sitting for an exam. ExamPaths content may not reflect the most recent changes to licensing requirements, regulations, or exam formats.

You must be of legal age to enter into a binding contract under the laws of your jurisdiction to use ExamPaths. By creating an account, you represent and warrant that (a) you meet this age requirement, (b) all registration information you provide is accurate, current, and complete, and (c) you will maintain the accuracy of such information. We reserve the right to refuse service or terminate accounts that we believe were created fraudulently or by ineligible persons.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you. Accounts are for individual use only. You may not share your login credentials with any other person, allow any other person to access your account, or sell, transfer, or sublicense your account to any third party.

If you believe your account has been compromised or accessed without authorization, you must notify us immediately at exampaths.support@gmail.com. We are not liable for any loss or damage arising from your failure to protect your credentials.

ExamPaths offers the following access plans:

• Basic Monthly — $19.99 per month, billed monthly, renews automatically each month
• Basic Lifetime — $29.99 one-time payment, no recurring charges
• Pro Monthly — $34.99 per month, billed monthly, renews automatically each month
• Pro Lifetime — $49.99 one-time payment, no recurring charges

All prices are in US dollars. Applicable sales tax or other taxes may be added at checkout depending on your location and applicable law. You authorize us to charge your payment method for the plan you select at the time of purchase and, for monthly plans, on each subsequent renewal date.

If a payment fails or your payment method is declined, we may suspend or restrict access to your account until the outstanding balance is resolved. We reserve the right to update pricing at any time. For active monthly subscribers, we will provide at least 30 days’ advance notice of any price increase before it applies to your subscription.

IMPORTANT NOTICE: MONTHLY SUBSCRIPTION PLANS AUTOMATICALLY RENEW. BY PURCHASING A MONTHLY PLAN, YOU AUTHORIZE MOJAVE WEB PRO LLC TO CHARGE YOUR PAYMENT METHOD ON A RECURRING MONTHLY BASIS UNTIL YOU CANCEL. YOUR SUBSCRIPTION WILL CONTINUE AND YOUR PAYMENT METHOD WILL BE CHARGED AUTOMATICALLY AT THE THEN-CURRENT RATE ON EACH MONTHLY RENEWAL DATE UNLESS YOU CANCEL BEFORE THE RENEWAL DATE.

To cancel automatic renewal, log into your account settings and follow the cancellation instructions, or contact us at exampaths.support@gmail.com before your next renewal date. Cancellation takes effect at the end of your current paid period. You will not receive a refund for any unused portion of a subscription period.

ALL SALES ARE FINAL. WE DO NOT OFFER REFUNDS, CREDITS, CHARGEBACKS, OR EXCHANGES FOR ANY SUBSCRIPTION OR ONE-TIME PURCHASE FOR ANY REASON, INCLUDING BUT NOT LIMITED TO: FAILURE TO USE THE SERVICE, FORGETTING TO CANCEL BEFORE A RENEWAL DATE, DISSATISFACTION WITH CONTENT, FAILURE TO PASS AN EXAMINATION, OR DISCONTINUATION OF YOUR EXAM PURSUIT.

If you initiate a chargeback or payment dispute with your bank or credit card issuer without first contacting us, we reserve the right to suspend your account pending resolution and to provide evidence of your agreement to this no-refund policy to the payment processor.

If you believe you were charged in error, you must contact us at exampaths.support@gmail.com within 14 days of the charge date. We will investigate and respond within a reasonable time.

You may cancel a monthly subscription at any time by visiting your account settings or by contacting us at exampaths.support@gmail.com. Cancellation stops future billing but does not entitle you to a refund for the current billing period. You will retain full access to ExamPaths through the end of the period you have already paid for. We do not prorate unused time.

One-time Lifetime purchases cannot be cancelled for a refund after purchase.

“Lifetime” plans provide access for as long as ExamPaths remains in active operation as a service. “Lifetime” refers to the life of the ExamPaths service, not the life of the user. If we permanently discontinue the ExamPaths service, we will provide at least 30 days’ written notice to your registered email address prior to service termination. No refunds will be issued in connection with service discontinuation, whether for monthly subscribers or lifetime access holders.

You agree to use ExamPaths only for lawful purposes and strictly in accordance with these Terms. You agree not to:

• Copy, reproduce, distribute, publish, scrape, sell, license, or create derivative works from any ExamPaths content without our prior written permission
• Use automated tools, bots, crawlers, or scripts to access, index, or extract data from the platform
• Attempt to reverse engineer, decompile, disassemble, or extract the source code or underlying technology of the platform
• Share your account credentials with any other person or allow any other person to use your account
• Use ExamPaths to develop, train, or improve any competing product or service
• Upload, transmit, or distribute any content that is unlawful, defamatory, obscene, or otherwise objectionable
• Interfere with, disrupt, or damage the integrity or performance of the service or its underlying systems
• Attempt to gain unauthorized access to any portion of the service or its related systems

Violation of any of these restrictions may result in immediate account termination without refund, and may expose you to civil or criminal liability.

All content on ExamPaths — including but not limited to practice questions, answer explanations, audio features, study guides, text, graphics, logos, software, and the ExamPaths name and brand — is owned by Mojave Web Pro LLC or its licensors and is protected by United States and international copyright, trademark, trade secret, and other applicable intellectual property laws.

Your subscription grants you a personal, non-transferable, non-exclusive, revocable, limited license to access and use ExamPaths solely for your own individual exam preparation. This license does not include any right to resell, sublicense, copy, or commercially exploit any content or feature of ExamPaths. All rights not expressly granted are reserved by Mojave Web Pro LLC.

You agree to defend, indemnify, and hold harmless Mojave Web Pro LLC and its members, managers, officers, employees, contractors, and agents from and against any and all claims, actions, demands, liabilities, losses, costs, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of or inability to use ExamPaths; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third-party rights, including intellectual property rights.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. MOJAVE WEB PRO LLC DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) ANY CONTENT IS ACCURATE, COMPLETE, RELIABLE, OR CURRENT; (C) ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR (D) THE SERVICE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IF YOU ARE IN SUCH A JURISDICTION, SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOJAVE WEB PRO LLC OR ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST DATA, LOST INCOME, BUSINESS INTERRUPTION, EXAM FAILURE, OR LICENSING DELAYS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE EXAMPATHS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE FORM OF ACTION OR THE BASIS OF THE CLAIM, SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY DOLLARS ($50.00).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IF YOU ARE IN SUCH A JURISDICTION, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

We may suspend, restrict, or permanently terminate your account and access to ExamPaths at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, us, or third parties, or for any other reason. We are not liable to you or any third party for termination of your account.

Upon termination for any reason, your right to access and use ExamPaths ends immediately. You remain responsible for all charges incurred prior to termination. Sections 7, 11, 12, 13, 14, 15, 16, and 17 survive termination.

Informal Resolution First. Before filing any legal claim, the party raising a dispute must send written notice to the other party describing the claim and the requested relief. The parties agree to attempt in good faith to resolve the dispute informally for a period of 45 days from the date notice is received.

Binding Arbitration. EXCEPT AS SET FORTH BELOW, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Nye County, Nevada, or by videoconference if agreed by both parties. The arbitrator’s decision shall be final and binding.

Small Claims Exception. Either party may bring an individual claim in small claims court in Nye County, Nevada, if the claim qualifies.

CLASS ACTION WAIVER. YOU AND MOJAVE WEB PRO LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this waiver is found unenforceable as to a particular claim, that claim shall proceed in court and the remainder of this Section shall continue to apply.

Opt-Out Right. You may opt out of this arbitration agreement by emailing exampaths.support@gmail.com within 30 days of first accepting these Terms, stating your name and account email address.

California Users. Nothing in this Section waives your right to seek public injunctive relief to the extent such waiver is prohibited under California law.

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law principles. For any dispute not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Nye County, Nevada.

We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, network infrastructure failures, pandemics, or acts or omissions of third-party service providers.

Promotional codes are offered at our sole discretion, may be modified or withdrawn at any time, have no cash value, are non-transferable, and may not be combined with other offers unless explicitly stated. We reserve the right to void any code we believe was obtained or used fraudulently.

Your use of ExamPaths is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using ExamPaths, you consent to the collection, use, and disclosure of your information as described therein.

We may modify these Terms at any time. For material changes, we will notify you by email or in-app notice at least 14 days before the changes take effect. Your continued use of ExamPaths after the effective date constitutes acceptance of the revised Terms.

Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and Mojave Web Pro LLC regarding ExamPaths.

Severability. If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions continue in full force.

No Waiver. Our failure to enforce any provision does not constitute a waiver of that right.

Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.

Notices. Notices to us must be sent to exampaths.support@gmail.com.

Headings. Section headings are for convenience only and have no legal effect.
